Us and Them is the second studio album by American rock band Shinedown, released on October 4, 2005. Recorded in Jacksonville, Florida and Sanford, Florida, the album had three singles, two of which, "Save Me" and "I Dare You," were used as themes for WWE pay-per-view events No Mercy 2005 and WrestleMania 22 respectively. Us and Them has been certified Gold by the RIAA in the United States. Us and Them is the last album to feature guitarist Jasin Todd and bassist Brad Stewart.

The track "Beyond the Sun" has since caused some minor controversy after the band claimed it as their own and registered a copyright for the song three months after the album's release. However, the registration was fraudulent because the copyright to Beyond the Sun already belonged to the three members of the band 3AE, who wrote and recorded the song in September 2002 (and had split in the same year due to the death of singer Christopher Rice shortly after the recording of their first album.) Stated another way, when Shinedown claimed Beyond the Sun as theirs in October 2005, they knew that Beyond the Sun was a 3AE song, that it was written by band members of 3AE, and they knew with certainty that no one in Shinedown was a writer or contributor on the song, despite or possibly because the two bands sharing the same producer.

Brent Smith revealed all in an interview on Radio Station 101.1 in Orlando, Florida, which can be heard here, and since then the whole argument has apparently been settled out of court. However, as the album had already been printed, the song is still credited as being written by the members of Shinedown.

This song was featured on a separate CD that was sold bundled with the album at Best Buy for a limited time following the album's release.

This song was an exclusive download that could only be accessed with a code found exclusively in versions of the CD sold at Wal-Mart.
